This is the current Terms of Service document for the Tatsukoi species! By owning a Tatsukoi and/or participating in the species you agree to follow our T.O.S.
General Rules:
- Tatsukoi are a closed species created by eggomancer and may not be created without the use of a Tatsukoi MYO slot.
- The creation of multiple on-site accounts is stricly prohibited. If you are found to have multiple accounts, all of them will be banned immediately.
- Members must be at least 13 years old or older to create an account on this site. Any user found to be under the age of 13 will be banned from the site and all other group spaces.
- Do not harass others or incite drama. This includes name-dropping and gossip, this rule extends to mentions of individuals outside of the group.
- Swearing is allowed in the group, but all slurs are strictly prohibited.
- Racism, sexism, ableism, zoophilia, pedophilia, facism, homophobia, and transphobia is not tolerated and will result in a ban.
- Discussion of politics, religion, and other sensitive topics is prohibited.
- NSFW is not allowed to be posted in the group's spaces. (this website, our Discord, our Toyhouse forums, etc.) This includes fetish art.
- No AI generated content should be posted in the group. A lot of it is built off of stolen artwork and I do not want it associated with the group in any way.
- Do not argue with staff. If you have feedback and/or criticism about our decisions please direct it to us by creating a report.
- There is no tolerance for scamming and you will be immediately banned if caught doing so. This includes creating and selling unofficial Tatsukoi.
- Do not guilt-trip, whine, or complain about the adoptable or artwork prices of anyone in the group.
- If you are having issues with another member or have found them doing any of the above, please create a report and we will do the best we can to deal with it!
PAYMENT, ADOPTABLE SALES, & AUCTIONS:
- Only admins, mods, and guest artists have the right to create Tatsukoi adoptables for sale.
- By default, payment for Tatsukoi adoptables will be collected via Paypal. However other payment methods may be available for certain sales. Once payment is sent, full ownership of the design will be transferred.
- Sale rules may be different for each admin, mod, or guest artist. You are required to follow each artist's rules.
- Every guest artist reserves the right to refuse sales to anyone.
- In auctions, do not bid unless you have the funds equal to your highest bid.
- If you require a payment plan, and the artist allows them, please discuss it with the host of the auction.
- Refunds are not available after payment has been sent.
- After claiming a design or winning an auction (and no payment plan has been discussed) you have 48 hours to send payment. If payment is not sent within this timeframe the design will be put back up for sale. In the case of auctions, the design will be sold to the second highest bidder.
- If you back out of multiple auctions or sales you may be banned from any future sales. (This may be temporary or permanent depending on severity)
- Anyone creating characters that are explicitly meant to be "offbrand" Tatsukoi (ex. Someone specifically saying that a character not involved with the species is a Tatsukoi or an offbrand Tatsukoi) are not permitted in the community. If you come across someone intentionally creating “offbrand” Tatsukoi please do not harass them. Please note that this does not apply to people creating designs that may simply resemble Tatsukoi, but are not meant to be one. If you see a character that looks similar to a Tatsukoi, but it is not meant to be one, please leave the owner and designer alone!
OWNERSHIP, TRADE, AND RESALE:
- By owning a Tatsukoi, you own the personal, non-commercial rights to the character. The Tatsukoi species retains commercial rights to the species, but we will never claim any personal or commercial rights to any individual character you or any other user may own. We will never claim to own or revoke any characters owned by any user.
- The only legitimate Tatsukoi are those listed on our masterlist. The trading and selling of Tatsukoi must be done through this site for the transfer to be considered legitimate.
- Any Tatsukoi is allowed to be traded for other Tatsukoi, other species, other character designs, art, customs etc.
- Paid USD MYO slots may be resold but slots earned from activities, in-game currency, and other events may not.
- If a Tatsukoi has NSFW / 18+ art in their gallery, it must be deleted before trading them. Adult users may ask for the art to be kept when the Tatsukoi is being traded from another adult.
- Three-ways and vouchers are allowed, but please be aware that the staff is not responsible for monitoring the legitimacy of them!
- Three-way trades and vouchers must be paid directly to the third-party.
- You may resell a Tatsukoi for the price you bought them as well as the worth of additional art and art created by the owner. However, if the price inflation is extreme you may receive a warning or ban.
- If you are caught selling a Tatsukoi (without any commissions or art) for more than they are worth, you will be asked to return the money and take back the design. Failure to comply will result in a ban.
- If a Tatsukoi is not being advertised as being up for sale / trade do not bother the owner or place offers on the character.
- If a Tatsukoi has an alternate form (either one-off designs or of other species) it must be traded with the Tatsukoi design.
- All Tatsukoi have a 1 week cooldown after being traded or resold.
- The masterlist will only record Deviantart or Toyhouse accounts, if you do not have both accounts listed on the masterlist you must trade from the account listed on the masterlist.
Designing your MYO + Redesigns:
- All designs must be an original concept. Do not copy existing Tatsukoi designs. If a design has too many similarities to a pre-existing design you will be asked to change your design.
- You may create a MYO Tatsukoi based on a design that you own. But if the design is not made by you, make sure that this is permitted by the artists T.O.S.
- Creating a Tatsukoi based on a copyrighted character is not allowed. However creating a design INSPIRED by a copyrighted character is fine as long as it is clear that the design is not an exact clone of them.
- You may commission an artist to create a MYO design for you, but you must make sure that they are willing to adjust the design if something is off with it. (ex. the design does not fit the species rules, design has a trait the slot does not have access to, etc.) The artist must also be properly credited on the masterlist.
- When redesigning a Tatsukoi, you may change the patterns, slightly shift the colors, change their gender presentation, and remove traits, but the redesign must be recognizable from the original design.
- Do not edit or trace other’s art when redesigning a Tatsukoi. (Unless permission from the artist is granted)
- You are free to make AU designs of your Tatsukoi, but please keep in mind that if the Tatsukoi is traded, both of these designs will be traded
- To have a design approved, please refer to our journal for MYO approvals.
- If you would like to void a design from the species please submit a report.
Bans and Blacklisted Designs:
- If you are banned from the group, your Tatsukoi's masterlist entry will be hidden.
- You maintain ownership of your Tatsukoi, but you cannot participate in the group or events.
- You are still able to trade or resell these designs (You may not trade them for other tatsukoi), if the member they are traded to is not banned they will be re-listed as a valid Tatsukoi.
- Blacklisted Tatsukoi cannot have artwork posted to the group. Users who do so will be warned. Users who continue to post the design after being warned may also be banned.
- Banned users who feel they have unrightfully been banned may note the group to appeal the ban by submitting a report or by contacting eggomancer.
